Hire Employees in Niue

2026 EOR, Payroll and Employment Guide

You can hire in Niue, but the person needs a local employer that is registered with the Niue Tax Office. Every business must hold a business licence, and employers file a monthly PAYE return on the 20th. You either set up a licensed local business, or use an Employer of Record, which employs the worker and carries the legal obligations while you direct the work. The national pension is paid from government funds, so we show no employer contribution rate. Confirm the current on-cost figure with your GX adviser.
Niue's income tax sits in the Income Tax Act 1961, which the Niue Tax Office administers for the Ministry of Finance. Employers deduct a regular sum from salary or wages when the Financial Secretary directs it, and the deduction cannot exceed twenty per cent of gross pay. A worker with a second job can fall under the tax code SEC, which carries a flat 10 cents in the dollar withholding on that second income. The national pension is not funded by employers. The Pensions and Benefits Act 1991 pays it out of the Niue Government Account to Niueans and permanent residents aged 60 or more. Foreign hires need a work permit under the Immigration Act 2011, and the currency is the New Zealand dollar. We found no general labour code or statutory minimum wage in the sources we could verify, so this guide leaves those figures for your GX adviser to confirm.

01 · Hiring in Niue

Can a foreign company hire employees in Niue?

Direct answer

A foreign company can employ through a licensed local business or an Employer of Record. Every business must hold a business licence from the Niue Tax Office.

Niue is a self-governing state in free association with New Zealand, using the New Zealand dollar.

Two routes exist. A licensed local business gives direct employment; an Employer of Record removes that setup and acts as legal employer.

All businesses must apply to be registered for a business licence, and the Tax Office publishes a form for overseas companies to register as a company. Licences expire on 31 May every year.

02 · EOR vs entity vs contractor

EOR, entity or contractor, which model fits?

Direct answer

We found no employer payroll contribution rate in the Niue legislation we reviewed. Confirm the current figure with your GX adviser.

The national pension is government-funded. The Pensions and Benefits Act 1991 pays it out of the Niue Government Account to Niueans and permanent residents aged 60 or more, so it does not run through employer payroll contributions.

PAYE is withheld from the employee’s pay and is not an added employer cost. Confirm the current on-cost figure with your GX adviser before you quote.

Whichever model you pick, check the worker against the contractor risk check before you rely on a contractor arrangement.

How much does it cost to employ someone in Niue?

Direct answer

Confirm the current figure with your GX adviser. The pension is paid from government funds and PAYE is withheld from the employee.

The pension is not an employer contribution. The Act provides for it to be paid out of the Niue Government Account from money appropriated by the Assembly, at a rate that Cabinet prescribes.

Where a second job is involved, the tax code SEC applies a flat 10 cents in the dollar withholding to the income from that other employment.

Confirm the current figure for any other employer cost with your GX adviser.

07 · Compliance risks

What are the main compliance risks when hiring in Niue?

Direct answer

The monthly PAYE return on the 20th is the deadline most likely to be missed, and overdue filings block the licence renewal.

The monthly PAYE return is the deadline most likely to be missed. It is due on the 20th, and licence renewals are refused where the previous year has overdue tax filings.

Operating without a business licence is the second. All businesses must apply to be registered, and licences expire on 31 May every year.

Using an old tax schedule is the third. Confirm current rates with the Niue Tax Office.

Contractor misclassification risk check

Answer for the Niue-based person you currently pay as a contractor. Indicative only — not legal advice.

01 Does the worker set their own hours and method of working?
02 Do they work for other clients, or is this their only source of income?
03 Do they provide their own equipment and workspace?
04 Are they paid against invoices for output, rather than a fixed monthly amount?
05 Can they send a substitute to do the work?
06 Do they carry their own commercial risk, including the cost of correcting defects?
07 Are they self-employed and assessed on their own income under the Income Tax Act 1961?
08 Is the engagement for a defined project with an end point, rather than open-ended?
